Terms and Conditions

These terms and conditions (the “Terms”) govern your use of the 500-ways.com website (the “Site”), which is operated by the Art Institute of Chicago (hereinafter “we,” “us” or “our”). By using or accessing the Site, you agree to all of these Terms, in addition to the terms and conditions of the website of the Art Institute of Chicago (http://www.artic.edu/aic/copyright.html).

  1. Privacy

    When you register to use the Site, we ask you for personal information (such as your name, email address and an account password). We may use the information you submit in order to facilitate the operation of the Site and to provide you with a better experience. We may use your personal information, including without limitation your e-mail address, to send you information about other activities, events, and promotions related to the Art Institute of Chicago. We do not sell, rent or share e-mail addresses with any third parties except select partners.

    If you are under age 13, please do not attempt to register for the Site or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible.

  2. Sharing Your Content and Information

    You own all of the content and information you post on the Site. For content that is covered by intellectual property rights, including without limitation text, photos and videos ("IP content"), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, worldwide license to reproduce, distribute, display, perform, or otherwise use any IP content that you post on or in connection with the Site ("IP License"). Everything that you submit to the Site shall be treated as nonconfidential and non-proprietary.

  3. Safety

    We are under no obligation to monitor or review discussions, postings, comments, or content of any kind on the Site and we assumes no responsibility or liability arising from such content or materials or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, danger, or inaccuracy contained in any information within such locations on the Site. We do wish to keep the Site safe, but we cannot guarantee it. We need your help to do that, which includes the following commitments:

    1. You will not send or otherwise post unauthorized commercial communications (such as spam) on the Site.

    2. You will not collect users' content or information, or otherwise access the Site, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

    3. You will not upload viruses or other malicious code.

    4. You will not solicit login information or access an account belonging to someone else.

    5. You will not bully, intimidate, or harass any user.

    6. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.

    7. You will not use the Site to do anything unlawful, misleading, malicious, or discriminatory.

    8. You will not do anything that could disable, overburden, or impair the proper working of the Site, such as a denial of service attack.

    9. You will not facilitate or encourage any violations of the Terms.

  4. Protecting Other People's Rights

    We respect other people's rights, and expect you to do the same.

    1. You will not post content or take any action on the Site that infringes or violates someone else's rights or otherwise violates the law. For example, you must receive permission from any person depicted in any photos that you submit.

    2. We can remove any content or information you post on the Site if we believe that it violates the Terms, or for any reason, in our sole discretion.

    3. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.

    4. You will not post anyone's identification documents or sensitive financial information on the Site.

  5. Mobile

    Please be aware that your carrier's normal rates and fees, such as text messaging fees, if applicable, apply to your use of the Site.

  6. Amendments

    We can change the Terms at any time for any reason by posting new Terms on the Site.
  7. Termination

    If you violate the letter or spirit of the Terms, or otherwise create possible legal exposure for us, we can stop providing all or part of the Site to you. We will notify you by email or at the next time you attempt to access your account. You may also delete your account or disable your application at any time. In all such cases, the Terms shall terminate, but the following provisions will still apply: 1, 2, 8, 9.

  8. Disputes

    1. You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to the Terms or The Site exclusively in a state or federal court located in Cook County, Illinois. The laws of the State of Illinois will govern the Terms, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Cook County, IL for the purpose of litigating all such claims.

    2. If anyone brings a claim against us related to your actions, content or information on the Site, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

    3. WE TRY TO KEEP THE SITE UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING THE SITE "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE SAFE OR SECURE. THE SITE IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR TRUSTEES, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR." WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE TERMS OR THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, THE SITE'S LIABILITY TO YOU WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

  9. Other

    1. The Terms makes up the entire agreement between the parties regarding the Site, and supersedes any prior agreements, written or oral.

    2. If any portion of the Terms is found to be unenforceable, the remaining portion will remain in full force and effect.

    3. If we fail to enforce any of the Terms, it will not be considered a waiver.

    4. Any amendment to or waiver of the Terms must be made in writing and signed by us.

    5. You will not transfer any of your rights or obligations under the Terms to anyone else without our consent.

    6. Nothing in the Terms shall prevent us from complying with the law.

    7. The Terms does not confer any third party beneficiary rights.

  1. NO PURCHASE NECESSARY.
  2. To Enter, there are four ways to enter this drawing:

    a) Visit 500-ways.com and click on the “Buy Art Institute Tickets” button to be registered for a chance to win “Behind the Canvas,” a tour of the unseen parts of the Art Institute. Entries must be received by 1/31/10; Or

    b) Follow instructions on cubes 107, 148, 239, 286, 403. Use a photo of the cube as your facebook profile picture. Get nine additional friends to also use the cube as their facebook profile. E-mail a link of all of their facebook profiles to [email protected] and you will be automatically entered to win “Behind the Canvas,” a tour of the unseen parts of the Art Institute. Entries must be received by 1/31/10; Or

    c) Follow instructions on cube 157 located at Citigroup Center, 500 W. Madison St., Chicago, IL 60661. Text 157 to 42227. Reply message will ask for a photo of the cube to be taken and e-mailed to [email protected]. Follow the prompts and you will be automatically entered for a chance to win “Behind the Canvas,” a tour of the unseen parts of the Art Institute. Entries must be received by 1/31/10; Or

    d) Follow instructions located on the inside of cube 5, viewed through the viewing hole, located on the NBC Plaza at 401 N. Michigan Avenue, Chicago, IL 60611. Text “005” to 42227 to be automatically entered for a chance to win “Behind the Canvas,” a tour of the unseen parts of the Art Institute. Entries must be received by 1/31/10.

    The Art Institute of Chicago reserves the right to disregard any entry that is late, misdirected, illegible, incomplete or incorrect. Entries become the property of The Art Institute of Chicago and will not be returned.

  3. Prize Details: The prize package includes one tour for up to 4 people of the “behind the scenes” parts of the Art Institute of Chicago. No prize substitution or cash redemption allowed by winner. Prize is not transferable. All taxes on prize are the sole responsibility of the winner. The Art Institute of Chicago reserves the right to substitute a prize of equal or greater value if featured prize becomes unavailable.
  4. Drawing and Awarding of Prize(s): Winners will be selected in a random drawing from among all eligible entries received. Drawings will take place on or about 02/15/10. Three winners will be drawn. Drawing and awarding of prizes will be conducted by a representative of The Art Institute of Chicago whose decisions on all matters relating to this drawing are final. Winners will be notified by e-mail or phone call to listed number. If the prize notification e-mail or voicemail is returned as undeliverable, the prize will be forfeited. Winners have 10 days to respond via e-mail or voicemail to accept the prize. If winner does not accept prize no additional winners will be drawn. Prize must be redeemed by 11/15/10. The “behind the scenes” tour will be conducted at a time that is mutually acceptable to the winner and to the Art Institute of Chicago.
